Could you please advise the statute of limitations for filing a small claims case in FL against a professional moving company?

Items were picked up by Best Price Moving n July 22, 2014 and were to be stored in Chicago until I reached Florida and called to have them deliver the items. They delivered the items on August 11th and that is when I realized there were many items lost, stolen, damaged or broken. They also used false advertising because their website says only they move your furniture, not a 3rd party but United Van Lines delivered mine and they just dumped everything in the living room, didn't put things back together or place certain items like beds and stuff anywhere like my contract with Best Price. I had to pay a new neighbor and he and I had to do what I paid them to do (used professional movers due to disability). Also, since they falsely advertised, is this a punitive damages case? I DID NOT SIGN the forms when the deliverers left and wrote a note on the pages I was to sign saying outlining some of my major complaints. I know I file in FL. Is this a 3, 4 or 5-year statute case? Coming very quickly on 3 years. I have been very sick since returning to FL and that is the reason for the delay but I do want to get some kind of justice. Boxes were smashed, glass broken, items missing.

This a CARMACK case. Unfortunately, if you didn't do the right things early on, you may have waived any claims. You will need to retain a lawyer, at some expense out of pocket, to review this issue and see what you have have to work with and where you need to deal with this as it could be Illinois, not Florida.

Your contract actually controls your claims. It likely defines those you have and limits those you can bring and where you can Bring the claims. Seek legal Help asap.

The statute of limitations will depend on the contract you signed and the relevant jurisdiction, it may not be Florida. However, the statute of limitations may be the least of your worries, usually the contract you signed contains requirements for claims and notifications with a certain time and also limits on what you can recover. You need to have an attorney review your paperwork and advise you.
