Say you work at 7/11 in Long island, NY. You take multiple scratch off tickets adding up to 100$-200$ and play them only to win a few. If you're caught, what will be the outcome?
That is petit larceny and criminal possession of a stolen property in the 5th degree - both A misdemeanors. The max punishments are 1 year in jail, $1,000 fine, 3 year probation. I am not suggesting that this would be the result in any particular cases. There may be ways to get a case like this dismissed.
What you are describing is a petty larceny. That is a class a misdemeanor and punishable by up to a year in jail. I would consult with counsel immediately.
Your question is more properly in the criminal defense postings so I am moving it there. You will get more responses from criminal defense lawyers. My colleagues are correct in their advice. If you are charged with the crime do two (2) things, 1. Say nothing to anyone from law enforcement no matter what they ask you other than your name and address and provide them with your ID and 2. immediately hire a criminal defense lawyer to represent you. In fact it would be a good idea to meet with a criminal defense lawyer now so you know who you are going to call and what the retainer fee will be. Good luck.
