Can I file a wage complaint for not receiving my vacation pay after a voluntary termination?
I resigned from my job shortly after my 10 year anniversary with the organization. Because there was no acting Executive Director, I was told by both the board president and treasurer that I would be paid my unused vacation time. Every former employee prior to me had received some sort of severance. Whether it was their unused vacation or 2 weeks pay for their service. I know this because I was the payroll administrator.
When I did not receive my vacation pay on my final paycheck, I assumed I would be receiving it the following pay period. I didn't so I emailed the Treasurer and she informed me that I wouldn't be receiving my vacation pay according to the employee handbook. The handbook does not specifically state that vacation would not be paid out, only unused personal days. I was advised to submit a wage complaint with the State of MI wage and hour division but before I do, I wanted to know if I should or pursue another avenue. There are other employment related issues that I'm also considering filing a complaint to address so I wondered if speaking with an attorney first would be helpful. Thank you for taking the time to consider my question.
