Fiancee and ex-husband divorced a few years ago and she is solely on the mortgage but gave him the house in the divorce. He says he cannot refinance a house unless the quitclaim is filed first.

Fiance should discuss this with her attorney as there may be special circumstances set forth in the decree. Often times. a deed is signed but held in escrow for the closing of a sale or refinance by one of the attorneys.

Please consult an attorney in your local county. Often times, divorce decrees require one party to execute a quit claim deed and the other to refinance. Most banks will not refinance the mortgage unless the other party is removed from the title by quit claim deed. Fortunately, an attorney can arrange for the quit claim deed to be held in escrow and given to the bank after the bank has agreed to the refinancing. A local attorney who has a good working relationship with the bank can usually accomplish this task without a great deal of work. Good luck
