the doctor took xrays. The xrays revealed the injury he caused. Instead of letting me know whats going on, he continued the "treatment" that caused the injury. He watched me get worse and worse for a whole year. I viewed my xrays with 5 doctors and ya.. it was AN OBVIOUS thing. Not to me to the doctors. Does the SOL here run after the one year too? Or does it move to "fraud" SOL?

Generally fraud cannot be used to benefit the bad actor and can be used to extend the statute. Speak to local malpractice counsel.

The facts are critical in this case so you should immediately contact a local experienced medical malpractice attorney. You certainly have grounds to argue that your lawsuit remains viable. Do not let any additional time pass without action. Good luck.

In California, the SOL is set by law, but when it starts running is not always black and white. It sounds like you should speak with a medical malpractice attorney right away, and ask him/her to assist you with protecting your rights. Michael Holmes
