How to get your child back in the US if spouse refuses to come back?

Business 8 views 2 answers
My soon to be ex-wife, who is not a US citizen or a permanent resident went back to her home country (Pakistan) with our 2 year old son who is a US citizen. She has filed for a divorce in Pakistan and refuses to bring back my son to the US because the law in that country will grant full custody of the child to her until the child is at least 7 years old. I have asked her many times to return and bring back our son, but she completely refuses to do that. What can I do to get my child back?

You must involve your local law enforcement authorities-- but you are very fortunate, in that Pakistan just enacted the Hague Child Abduction Convention. The convention is discussed here... https://www.hcch.net/en/instruments/conventions/specialised-sections/child-abduction You will also want to consult a local attorney, of course, but the police must be your first contact.

I agree with attorney Lukken. You may also want to contact the US Embassy in Pakistan for references of local counsel there that can assist you.
