What recourse do I have if my tenant is 2 and a half months behind with rent?

I keep getting excuses about why the rent is late. This has been a pattern since they first moved in. Tried working with him but can't continue. I do have a signed lease.

You must file a failure to pay rent pleading in the district court. Talk to an attorney to walk you through the process.

You can file a Complaint for Repossession for failure to pay rent -- which may or may not result in an eviction if the tenant is able to pay the amount due and owing before the actual eviction occurs. You can also file a brach of lease action -- failing to pay rent is a breach of the lease. Simply provide 30 days written notice of the breach and then after the time period has expired, file a breach of lease action with the district court -- this way you can get the tenant out without the tenant being able to redeem the property by paying rent owed. If It were me, I'd take both courses of action -- the failure to pay rent action happens more quickly and chances are, if the tenant can't pay the rent now, the tenant most likely won't be able to redeem the property.
