My fathet has passed on and my mother still lives there..She is 84 and very unwell and is going to move in with my sister. But, my mum says i cannot rent out the house as she had a clause put in at solicitors stating i cant sell or rent it until she passed on...is this correct....The house was council and bought solely by me, but it had to originally be put in there name, because of the discount to the tenants. My dad then changed the deeds into my name about 10 yrs and when he died the will said the house was mine...complicated i know...

This is complicated and a little confusing - enough that I would recommend you consult a local attorney so they can pull the deeds for review and discuss all facts/questions with you. I apologize for not being more helpful, but sometimes the situation is just too fact dependent for a general discussion board such as this. ask her to prove it. look at the title and see if she / they conveyed a life estate to themselves. another issue I have is why this is even a question. if she is moving out to live with your sister and the house has no tenants what happens if you rent the house? if she has a life estate she might be entitled to some or all of the rent payment. this isn't that complicated. if the will states the house is yours you have to look at whether that was free and clear or subject to conditions such as indebtedness and title restrictions. then make sure the title accurately reflects what should have happened. Honor restrictions such as life estates. If you need help get with a local real estate attorney with all of your documents.
