Can I get a refund for being wrongly charged years of monthly fees for my checking account?

I called about an overdraft fee and while talking to the bank employee they discovered I was paying a monthly fee which should have been waived since I had direct deposits. They changed my account to a core account and gave me a refund for the amount of one months fee charge. However, I have been charged this fee for over 10 years. Can I get that money refunded since they didn't set my account up correctly? The employee was puzzled as to why no one had caught it.

It depends upon whether the "bank" is state or federally chartered and by which agency chartered it. It also depends upon whether the overcharge was a result of an original mistake or by reason of a more recent change in terms for the type of account. It is possible that a Missouri Merchandising Practices Act claim exists.
