You may have a case. Obtain your records and contact a LOCAL medical malpractice attorney. There is one year statute of limitations from the date of injury.

Possibly although this may be a rare risk of the procedure it can also be due to a departure from accepted practice and only an expert review can make that determination. Speak to local malpractice counsel.

Malpractice requires a showing of a breach of the standard of care. Obtaining your medical records and having them reviewed by a medical malpractice attorney and an expert will determine whether or not such a breach occurred, of if this was what is termed an "acceptable risk of the procedure". If a breach of care can be determined from the records in either the procedure or even in post operative care, your damages are such that you would have a good case.

Unfortunately, it depends upon details that exist in the medical records. Injuries like these can occur as the natural and inherent risk of the procedure. But they can also occur when the doctor does not perform the procedure properly. Also, whether you have a case that a lawyer will pursue will depend upon several things, including damages. If you have no children, desire children, but now cannot have them because of the procedure, that would represent significant damages that may be important for you to pursue. But, again, the medical records will be key.
