I have a Green Card, but am out side US for the last five years. Do I need to reapply fro green card?

My son applied for my Green Card and I obtained it in year 2011. I could not find a job at US due to education not acceptable to them. I am a Petroleum Engineer with around 40 years of experience. My efforts for job seem fruitless because of my age too. Now I like to open a store and arrange self employment. I can invest around $ 400,000 and arrange a franchise at US to support my self. I like permission to reenter and set up a franchise so that I have proper means of living for my self and wife.

Your green card is not valid any more. Your justification for leaving the US for 5 years will not help you. You or your son acting of your behalf will need to retain an experienced immigration attorney. Only an Immigration attorney has the expertise to properly fill out immigration forms and put together the right package of documents and other evidence to support the immigration benefits you are trying to obtain. However, especially in these turbulent times, you really need to retain an immigration attorney. This is not a do-it-yourself project! You should focus on retaining experienced immigration counsel, especially now that immigration is much more restrictive since Trump is now President. Immigration is a very complex area of law. It is a lot more than merely filling out forms. You need to retain an immigration attorney to handle all immigration proceedings. This prevents errors that can sometimes prove costly and may even be irreversible. You should always seek to obtain the best attorney that you can afford and not let geographic restrictions stand in the way. Some immigration attorneys will charge a consultation fee, however those that do so, will give full credit if you retain their law firm. Do not let geographic restrictions prevent you from obtaining the best possible attorney. Good luck.

I agree with my colleague. A new I-130 and new immigrant visa will be needed. Talk to an attorney via Skype.

Your status does NOT end merely by the passage of time. There are only two ways you can lose your residency: 1. You voluntary surrender your residency and file form I-407. 2. An immigration judge says that you abandoned your residency, Having said that you must work with a competent immigration attorney to help you reenter and to prepare you for what may happen when you reenter. I have had clients who have stayed out in excess of 10 years who were able to reatin their resiency in limited situations.

Your previous card is no longer valid. You'll need to surrender it and do a new petition from your son.
