Do I have a case to be found not guilty for possession of sch. 1 or 2?

I was charged with Felony possession of scheduled 1 or 2. The charge was based off of a filter that was 2 weeks old and used to draw heroin through. Would this have not been a misdeamenor paraphernalia charge? I had no drugs on me or my vehicle, but was charged withpossession from a filter. I am getting ready to go to court in 2 days and face conviction and try f or first offenders program. Do I have a chance at fighting this? Unsure of Virginia laws in regards to what constitutes paraphernalia or possession charge.

The residue left behind on the filter is enough to convict you of possession. If you have no prior drug offenses you could seek a first offender disposition. You should consult with an attorney that can help you navigate this process. I wish you the best.

All it takes is one tiny little speck to be convicted (as long as there is enough to be professionally analyzed). Residue can be analyzed. This is a felony charge. You really should have a lawyer to help you in court. It's not as easy as you may think.

I am so sorry you waited until two days before your court date to inquire. You had better get yourself a criminal defense attorney immediately. That should be your highest parity. A conviction will leave you with a lifetime criminal record that will skew and damage your employment options for the rest of your life.
