Do all documents( in a capital murder case) get put in the file within the circuit clerks office? Alabama case

Business 3 views 5 answers
My loved one was just convicted of Capital murder and I have been going to the clerks office to get copies of the file. Are there parts of the case that are not included in the clerks file? If so, why? And how do I obtain those documents? And it's a hardship financially is there any type of legal aid to help a person who cannot afford the copies? Thank you

Since he was convicted of Capital Murder, your loved one should request and most likely will be entitled to receive a copy of all transcripts at no charge. I am sure there is an appeal process going on even as we speak. There will be numerous advocacy groups from all across the country who will review his case and become involved in the appeal process over the next 20 years or more.

There should be an appeal. Is so, your loved one will have an attorney. That attorney, not the family, will be given everything. The attorney is obligated to share with the client. That's how it works.

To answer the question you actually asked, which was: Are there parts of the case that are not included in the clerks file? If so, why? Yes there are. The Clerk has the written papers that have been filed in the case before, during and after trial, and the court reporter has everything else, by which I mean the court reporter has all the items and documents that were placed into evidence or offered to be placed into evidence during the trial. The reason is that the Clerk and the court reporter have different roles. The court reporter has what was brought into the trial and offered to be shown to the jury. The judge might or might not have let the jury see some of it, but the court reporter will have all of that. The other responses are correct. The lawyer who handles the appeal will have it all - both the Clark's part and the court reporter's part.

Your loved one needs to ask for an appointed attorney. That attorney will get all the court documents for him. You don't need to do this yourself.
