i'm on my second dui and was required to put a breathalizer on my truck. i have faithfully driven my truck acohol free..you can't do anything but that. I feel that I am not a threat to society with this device on my truck, and thought this was part of my sentence to keep me from driving under the influence of acohol, for you must be sober to operate it. however while on probation the PO has used this to moniter my drinking. I have had violations due to drinking the night before and was forced by my PO to sign a no acohol motion with the court..any rights here..feel like i was manipulated? This has occured in ft. worth,tx

All probations in Harris County, and most alcohol and drug related probations in other counties require the probationer to remain alcohol free. You are lucky you have been able to drink at all while on probation. You have no right to drink while on probation for a 2nd DWI.

When you sign up for probation in Texas, you are agreeing to allow the court to change or modify your Community Supervision conditions at any time. The only right you retain is the right to a hearing if you are accused of violating a condition of probation. Good luck to you on the duration of your probation.

Most DWI probations prohibit the use of alcohol completely during the period of probation. Although, it is not against the law to consume alcohol many judges feel that they are setting you up for failure if they allow you to drink at all. One of the biggest problems is that repeat DWI offenders are causing a lot of carnage on the highways with DWI collisions. This is putting all drivers in the same basket if the smell of alcoholic beverages is present. I think you should hire an .com rated DWI attorney in your area and let them help you during you probationary period. Go to dwidude.com for more important information.
