Plead guilty to reckless endangerment after being arrested for DUI

Business 2 views 2 answers
After pleading guilty, I was sentenced to a year in jail suspended and 2 years probation- i take weekly UA's and every one of them has come back as diluted. I called my doctor to find out what this meant and what causes it - he told me that being diabetic, its not uncommon to have this happen. Anyway, I had a show cause hearing where they revoked my being out on my own recognances, and gave me a $1000 bond. IF I have already been sentenced, then how is it that I can get a bond? and I thought if you violated probation, no money in the world could get you out rather you served the time set at the probation violation show cause hearing?

You should contact an attorney licensed to practice law in the state of Washington to help you with this case. From your description, it doesn't sound like the court has actually ruled that you violated the terms of your probation. It appears that you are being accused of violating the terms of your probation and that is why the court gave you the opportunity to post bond regarding the alleged probation violation. Based upon your medical condition, it might be a good idea to get medical documentation from your doctor discussing how your diabetic condition may cause your dilluted samples. In your case, it sounds like you have some suspended jail time hanging over your head (time that the judge did not order you to serve as a part of your original sentence). The judge can order that you post a bond to stay out of custody while he or she decides whether or not to order you to serve some of that remaining suspended time. Assuming that is what is going on in your case, you probably have another hearing coming up to address the alleged probation violations. If you don't have an attorney representing you yet for this hearing, you should get one (either hire one, or screen for a public defender). Your attorney should be able to help you present the medical issues to the judge. Hopefully, this will convince the judge that there was no probation violation, and that he/she should not order any additional jail time on the case. If that is what the judge does, you should ask that the bond be exonerated (returned to you).
