What happens if my P.I. attorney drops my case?

7 views 3 answers
I had an accident 15 months ago in Las Vegas and hired an attorney.. I had 38,000 in medical bills. The attorney was almost ready to file suit after 15 months. I will be filing Chapter 7 in NV. After speaking to my P.I. attorney, I believe he will drop the case because of the filing of the chapter 7 in NV. Does he have to give me or my new attorney if I hire one, the complete file?

Your current attorney will have to give your file to you or your new attorney, but you may have to first pay any outstanding fees and costs before the file is released if your attorney asserts a retaining lien. Consult with your new attorney regarding your rights.
