Many applications for driver's licenses ask if you have any tickets pending? If you do, they would not issue a license.

If you are able to trade in a valid illinois license for a missour license, and are subsequently convicted of dui in illinois, it will be treated by Missouri the same as any out of state dui.

Before dealing with the issue getting a DL in Missouri, I recommend retaining local counsel in the state with the new DUI to explore possible defenses to the DUI and to promptly file a petition to rescind the implied consent suspension. Sounds like you are presently in the waiting period before you will be summarily suspended for the DUI. Apart from the criminal charges of DUI, each state has technical rules and time limits for filing (and for the state's response to) a civil petition to contest/rescind the implied consent suspension before a judge(in Illinois its called the Statutory Summary Suspension). This hearing is a civil proceeeding and the driver has the burden of proving the police officer failed to follow the law when he reported the DUI stop to the DMV Agency. The officer's report forms the basis of your Statutory Summary Suspension. Your best plan is to get timely advice from an experienced attorney. Ruben Sanmiguel
