I am being charged with domestic violence, and disorderly conduct, both misdermeanors. I recieved the complaint summons and fingerprint order all at once, yet I was NOT arrested. never booked, NOTHING!! Is this legal? I have to be fingerprinted, and photographed, like I was arrested and booked, but wasn't. Please tell me they have done something wrong. I have never heard of such a thing. This is thru Municipal Court in Mesa.
The answer is yes. You must comply. Some people are arrested and booked and others receive a summons. The good news is that it should not be a long drawn out process. If you had been arrested you could have been there for hours, held in a cell maybe even overnight.

The State had two option to initiate criminal proceedings. They could have arrested you, or they can send you documents indicating that they have a court date and need your fingerprint and photo. The process you note is normal, and you must comply with the Order. You should consider retaining counsel to help you through this matter and best resolve your case. Please feel free to give a call.
Yes, it is legal. You may be charged with a crime without being arrested first, it is just more unusual. You must comply with the order you received or you certainly will be arrested.
You should hire a criminal defense attorney to help you deal with the charges. I have dealt with cases of this type and would be happy to set up a meeting with you.
