I was offered a settlement from the US military because of a medical malpractice case I had against them, i was just wondering how long it would take to see anything from the settlement once it is offered.

I am licensed in Nevada, but this answer should apply in California as well. This is a difficult question to answer, but I'm going to try and give you some information. There are many variables to this answer. If any benefits were paid by medicare, they will have to be contacted to determine their lien amount, if any, against the case. This can take some time. I'm assuming that, since you received medical care through the military, that the US Government may also have a lien against the proceeds for treatment rendered after the malpractice (if any). This too could take some time to determine the amount. If you received treatment after the malpractice for malpractice related items, the medical providers, government and/or private insurers may also have liens against the proceeds of the settlement. Those amounts, if any, will also have to be determined. Once all lien amounts are determined (if any) you (or your attorney) may want to seek discounts from the medical providers and/or insurers which will put more money into your pocket. Again, this will take some time. As you can see, there may be some time yet to go. Be patient. Hope this helps. /s Donald Kudler http://www.capandkudler.com

A settlement is like a contract. This means that it should be in writing and should contain all of the terms, including when and how you will get the settlement funds. I hope that you have an attorney assisting you, at least as far as assessing the offered settlement and its terms, as well as the sufficiency of the “contract.” Best of luck to you. When you make a settlement you should include in the terms the amount of time the defendant has to pay. I would assume in a case involving the government they would want much longer to process payment than a private company would. Make sure your attorney gets a clear agreement on how long it will take them to pay.
