I plan to marry a dominican woman, in santo domingo dominican republic and immediately file for a spouse visa to bring her to Tennessee. I want to know if i need a prenuptial agreement for dominican republic and the state of Tennessee. What i want to protect in prenuptial agreement. -protect my home, which i own - assure custody of children we may have - minimise or eliminte alimony, if we divorce. - possibly add a clause that if she is unfaithful she would be required to re-imburse me for incurred expenses .

If you wish it to be valid in Tennessee, it will need to conform to Tennessee law. It may be possible for it to be signed in the DR. Your home and the alimony issues are probably something you can resolve by a prenup, but you won't be able to do a binding agreement about custody. Custody will always be decided using the children's best interest, no matter what a prenup might say.
