What should I do if I had a .081 result from the Ottertail County Intoxilyzer in 2008?

Was convicted of DUI solely on the result since field tests were refused by me. First test was .081 and immediate second test was .086. Should I fight to get this overturned due the errors in the code with that machine?

Thank you for the post. You indicate that you were convicted. I assume that means you already have had a trial or that you entered a plea. How the conviction occurred is very important. You shoudl consult with an attorney, since any appeal must be filed within sixty (60) days after a verdict. For a consultation call 612.240.8005 or visit dwicounsel.com

An appeal is based on errors of law, and so you do need to consult with an attorney ASAP to determine if the trial issues fall into the context of legal error, and this must be filed quickly. A motion to suppress should have been filed in advance of the trial. I truly wish you the best. If you find my answer helpful, please click the ‘thumbs-up’ tab below. Thank you.
