My Girl Friend is in a custody battle for her daughter. I am not the legal father. The battle is in New York. I am a legal resident of Missouri. Can I be ordered to take a drug test by the court?

Are you living with your girlfriend in the same residence? If so, it is entirely possible, if you are living in the jurisdiction of the court with girlfriend and child is living or going to live there. (By the way, if you are living together, it may have an impact on the custody decision....depending on NY's court decisions about the exposure of children to "meretricious" relationships by unmarried folks.) Need more information. Are there allegations of drug use/abuse? Do they have any merit? Is the other party being required to take a drug test? Is the other party trying to harass mother by asking court to test her? (If so, ask court to require him to pay for all drug tests if the results are negative, by the way.) Is your girlfriend trying to GET custody or KEEP it? What grounds are alleged to support a change? Let me know.
