Do our daughter have a legit claim? She left the company after this happened and called corporate. They have called her back. My daughter took a job as a server at a local national restaurant and was yelled out by a manager who apologize then did again. She was also pushed by another employee. She was asked by 1 of 4 managers (Brandon) to remove her tank top under her work shirt. She went to restroom to do and when she came out Brandon told her she was suppose to take off in front of him. In addition She was pushed by another server and another manager hollered at her then apologized only to do it again within a hour. I believe she was not paid all of the min. wage during training.

It is likely that she has a claim, but for sexual harassment rather than discrimination (though of course there may be additional facts which are not disclosed). I would have to speak with her to determine the facts and whether she can recover a substantial amount.

I agree that you need to speak with an experienced employment attorney. Your daughter may have a claim for sexual harassment and wage and hour issues related to the training pay. Oftentimes, there could be additional pay violations that an experienced attorney will be able to uncover. Many attorneys offer free consultations and work on a contingency fee.

This sounds like sexual harassment and possibly wage & hour violations. You should contact an employment or discrimination attorney for an initial consultation. Many offer free consultations.
