What happens if the officer does not show up to court in my case?
Anonymous1 views2 answers
I have two petty tickets that I have scheduled for court dates. One is a park curfew ticket... I was in a closed park 15 minutes passed closing.
Another is a littering ticket from 4 years ago.

If he doesn't show up, then the prosecutor likely will request a continuance, which means he will ask the judge to set a new date for your case. If the officer continues to miss the court dates, the prosecutor either may dismiss the case, or the judge may require the state to move forward without the officer witness.
If he does show up, then you have a trial on your hands. You can either fight it, take what the prosecutor is offering, or go to the judge for sentencing.

If the officer does not show, then the prosecutor will likely ask for a continuance which the judge may, or may not, grant. If the judge grants the continuance, your court date wil be rescheduled. If the court denies it, the case will be dismissed, although it could be refiled. (This is only if you have the cases set for trial. The cops do not show up except on trial dates.)
If the officer shows, then you will be given an opportunity to plea bargain with the prosecutor. If you do not accept the offer and they don't accept any counter offers you make, then the case goes to trial.
