Non compete

I signed a noncompete with a company that sells gutter overhangs. I do not work with them anymore. Can my husband start a gutter company using the info I gathered from my previous job with my former employee?

That happens to be a very good question. First, look to the agreement. It is difficult, of course, for an attorney to interpret a contract without seeing the actual words. Focus on the precise words used. Noncompetition agreements usually are not construed in an expansive way. You may want to re-pose your question and state the exact terminology used in the agreement. Please note that I am a New York attorney and cannot advise you as to the application of Louisiana state law. For that reason, you may wish to consult with a local attorney. Good luck to you.

Louisiana has some strict requirements for the enforcement of non-competition agreements. If those requirements won't met, the agreement might not be enforceable against you. And, if your husband didn't sign the agreement, then he can probably start up his own business. With respect to the information, review your agreement to see if it has provisions prohibiting you from disclosing the confidential information and trade secrets of your former employer. Even if it has such provisions, you may still be able to use what it in your head, under certain circumstances. Good luck!
