Question for trust or personal injury lawyer
Anonymous3 views2 answers
My son won a personal injury settlement. Money was placed in a trust and certain other amount in financial institutions in case any needs arise before age 18 6 months ago we had some situation where we had to spend a lot of money for medical equippment and other stuff for our son. We asked the judge to release the funds so we can get money back but its been over 5 months putting us in a bad spot financially as we have 3 kids, my question is there a time limit for a judge to release those funds or ok it as we sent in all paperwork and proofs of biill and receipts of cost over 5 months ago?

If you had a lawyer assist you with the request for the funds, I suggest you contact your attorney and have him do a follow-up. If you made this request on your own, I suggest that you contact the clerk of the court where the judge sits and inquire about the status of the request and ask if there is any further information which might be required from you. Hopefully this will give them the nudge they need to rule on your request.

The only way there should be a time limit is if the Judge placed a time-limit in the Order of Court. Of course, if a lawyer helped create the trust, you should be asking your lawyer directly for updates. Otherwise, you can always follow up with the court to inquire about decisions and timelines made.
Hope this helps.
