Can I change my lawyer in the middle of Immigration process and get my money back from him?

Hi, my name is Farukh. I have an asylum case. The individual hearing is already scheduled on January 2011. My lawyer did not include my wife in the application in the begging, so when it was time for her Master hearing for deportation I asked my lawyer to include her. He said it is going to cost extra $4000, beside $7000 that I already paid. I said ok and made a consolidation of our cases myself. Now he is saying that as it is two people in the case he wants $3500 more. I don't want to work with this lawyer anymore. How can I cancel the agreement and get my $7000 or at least part of it back? I have the agreement which states the total price of $7000 and says nothing about additional people in my case. After all its my wife, and we are family, its ONE case!

First you should put in writing that you no longer want this attorney to represent you and you would like your money back. Second, if that fails you can file a fee dispute with the New York State Bar. Give me a call and we can discuss your options. Regards, Nick Misiti Misiti Global 716 830 7960 [email protected]

You have the right to chose counsel so if you locate a new attorney, the transition can be smooth as long as all sides will remain civil. In terms of getting money back, that is probably an issue addressed in the contract. so you should review that carefully and civilly talk to your current attorney to try to work it out.
