My uncle got a letter in mail showsn Notice of Correction and Proof of Service.. it shows a court date. in November. What does this mean... he did get a DUI ticket 5 months ago in Pomona, CA, but he never filed and charges and the the blood test came out to be lower than 0.08%.
What does the letter indicate, what charge is he facing. Can he postpone the court date, he is out of the country and won't be back until December.
The notice he received is a notice of his arraignment date for his pending DUI case. It is typical for someone to receive notice some 6 months later after the arrest date. The fact that he was under a .08 will be helpful in defending himself in the case but it does not mean the DA will not pursue a criminal case. In California you can be charged with either 23152(a) or 23152(b) – typically you will be charged with both. 23152(a) does not have a required BAC but rather the prosecutor must prove that at the time you drove you were unable to drive a vehicle with the same caution and care as a sober person. He will need to appear in court on the date of the arraignment or hire an attorney to appear for him. You should look into hiring a good DUI attorney to assist in defending the case.

Thank you for your posted question.
The answer, to be frank, is that your uncle, or an attorney on his behalf, has to show up in person, or have an attorney show up on his behalf. The letter should indicate his charges, or the court will have that information when he or his attorney shows up on the court date.
I hope that this helps you, but if you have any other questions, please don't hesitate to ask.
