Defendant paid me what they owe after they were served court papers for small claims court. How do I can cancel my court date? Do I just fill out a request for dismissal and mail it in?

You can file dismissal papers with the court, which is better than not showing up to court and having the judge dismiss the case for parties not showing up. Filing in person is better than mail if this is possible. Hope this helps. If you found this useful, please note so by clicking the thumbs up button. If all the issues have been resolved through the payment, then generally a Motion To Dismiss or Motion for Voluntary Dismissal is filed to dispose of the case. In the Motion, you should advise the Court that the matter has been amicably resolved and that you "move" for a dismissal. The dismissal can be "with prejudice" or "without prejudice." By dismissing with prejudice, you are essentially asking the Court to dismiss the case and precluding the case from ever being brought again. By dismissing without prejudice, you are asking for a dismissal, but it allows you to potentially reopen the case or to file a new case later on.
