You should immediately confirm by fax or email that you were fired over the phone, giving the date and time of the call and who called you to fire you, and what was said. Then, assuming you were not on probation during the first 90 days of your employment, you are entitled to file for unemployment compensation. The reason for putting it in writing by fax or email is to prevent your employer from changing the story and say that you abandoned your job by not showing up on the following day when you were supposed to report for work, and that you were fired for job abandonment. After you file for unemployment, your employer then has a chance to respond, and you have a right to see what they say as the reason for your discharge. If they contest your right to unemployment, you should look to hire a lawyer several weeks BEFORE the hearing before the Appeals Referee, to allow the lawyer to subpoena witnesses in your favor and to secure any documents from the employer. There is nothing wrong with firing someone over the phone, but if you are fired because of discrimination on the basis of race, color, religion, sex, national origin, disability, age, you may have a valid claim against your employer. Although Florida is considered an at-will employment state (sometimes referred to as at-whim) which means an employer can fire you for no reason at all at any time just as you may quit a job at any time, there are many exceptions to this rule, and I would advise you to seek out legal advice from an in person consultation with a lawyer who specializes in representing workers in discrimination cases.
