Can you explain the differences when faulting adultery for divorce.

I want to list adultery as the fault for my divorce. I know who the person is and have documented proof. I was told to list adultery with an unkown instead of naming her, I am not sure for what reason. Can you explain.

Irretrievable Breakdown of the Marriage is the easiest and most common grounds for divorce in Massachusetts. If you want to list adultery, you will have to prove that adultery occurred if the other party does not admit to it. This could be problematic because it usually involves getting the 3rd party in to testify that they cheated with your spouse. You should think long and hard (and preferably with the assistance of an attorney) before filing under Adultery.
