Open container ticket Bc of a Tervis cup w urine in it?
Anonymous3 views2 answers
Leaving a concert my husband and I were pulled over for “driving too slow” (I was lost and waiting for Suri to give me directions). I was given a sobriety test which I feel I did well on but was still arrested for DUI. There was a Tervis cup w urine in it bc my husband had to pee otw there earlier. He was issued an open container ticket bc the officer said it smelled like alcohol. I did have a drink at the concert but was not drunk. I probably looked drunk bc my husband and I had a fight leaving the concert so I’d been crying. I did refuse the breathalyzer test bc I was scared and didn’t know what was the best thing to do. So what now? Should we fight both charges? Is there a chance we can beat this?
Yes, by hiring criminal defense attorney who handles traffic matters your chances of winning your respective cases will improve, as you do not understand evidence, criminal procedure, etc. If you pay the fines, you are both pleading guilty; and if you miss your court dates you will face bench warrants. Besides a misdemeanor on both your criminal records, you face licence suspension, higher insurance rates, and loss of many employment opportunities.

Your best shot at beating the charges is to retain a DUI attorney. DUI charges can be tough to beat, even for experienced DUI attorneys, so I absolutely do not recommend representing yourself and hoping to beat them. The Find a Lawyer feature at the top of the page can help you find DUI attorneys in your area.
