Business 1 views 3 answers
I was convicted of a DUI and a 2800.1 in San Diego Ca in May of 2006. As a result I lost my job. I was going to the court ordered dui classes but couldnt pay for them so I stopped going. In 2007 I was rearrested for not attending the classes and re referred to the classes. I stil could not pay for the classes. Today is 11/3/2010. The place I work went out of business yesterday. I need to get this case taken care of and I dont know what to do. I cant affford and attorney or the classes. What should I do....I dont want this hanging over my head any longer. I have not commited any other crimes since the original DUI in 2006.

You could apply to have your probation terminated and then to have the DUI expunged. However if you currently have a warrant out for your arrest you are going to want to deal with that first. I know that you said you cannot afford an attorney but you are likely going to need one. Perhaps you can check into legal aid, I know they have some in San Diego: http://www.lassd.org/ Good luck and best wishes, Jason Beahm Beahm Law Expungement & Criminal Defense

Worst case scenario you return to court explain this to the judge and the judge will eliminate the DUI class and any remaining fines and fees. However in order to get this done you will have to most likely spend some time in jail. It is not the greatest option due to the jail time but it would get this cleared up. You other option you can try is to contact the public defender’s office they may assist you. Robert Driessen www.driessen-litigation.com

Call the San Diego County Public Defender ((619) 338-4700) and ask to speak with the PD of the Day. Explain your situation to them and see if you qualify for the PD's services. You will need to get that bench warrant taken care of as soon as possible. You could add yourself to calendar and hope that the judge either appoints the Public Defender or accepts your explanation and is lenient, but I would not do that until you speak with the PD.
