In the N-400, Part 10, Question 5: Do you owe any Federal, State, or local taxes that are overdue

1 views 1 answers
I filed my 2009 taxes on time along with an application for a payment plan. It got approved and the IRS now takes monthly withdrawals from my account. Is the answer to this question yes or no? I do owe taxes because the payment plan is not over, but I am not sure they are considered overdue since I filed my taxes and the payment plan on time, and I have followed with all scheduled payments.

I think the answer is yes because you are to file your federal tax returns on April 15 with any taxes that are due. I recently had this come up with a client who owed over $ 5000 to the IRS and was repaying them at a rate of $ 100/month. We submitted proof that he was up to date on his payment plan. He is now scheduled to be sworn-in as a United States citizen later this month. www.accentlegal.com
