On the 6th of July, I was in safeway buying groceries with my mom. So as we got done checking out we were leaving. She walked in front of me and I was following her and then I slipped on a rug which had a big puddle of water under it. It was by a ice machine which happends to be right near the walk way to exit the store. There wasn't a CAUTION WET FLOOR sign there. They put thee sign there after I already fell! Everytime I return to the store the sign still is never there. I only go to that store because its the closest one. So as one of the managers helped me up my righ side of my body was in pain. I had landed on my hip and my back. I went to the hospital like a day after and the nurse checked me and told me I have bruising in my back If i would have hit more harder then I would have broke my hip. Since months have passed I still have the pain. I tried all tyes of pain killers hot and cold packs and nothing works. I cant lay on my back I cannot sit or stand for a long period of time without having to reposition my self. If you berly touch my back it hurts really bad. What can i do? By the way they told my mom all they can give me is a safeway gift card.when we filed a report it took them weeks just to tell us that were getting a gift card

I've actually been at the Safeway in Menlo Park at which you fell (not that it's relevant to this response). You definitely have a personal injury case to pursue. You should not agree to settle with the gift card. However, you should also not set your expectations too high. Moreover, in a personal injury case, the plaintiff is prohibited from indicating the amount of damages sought in the complaint. In any event, even assuming liability is admitted, the value of the case depends largely upon the extent of injuries, the medical bills incurred, whether or not the injuries are permanent, and whether you sustained loss wages as a result of the incident. I recommend that you retain a personal injury attorney in your area to pursue this claim.
