Can I sue my husband for money that he owes me?

My husband had a direct deposit set up so that I could receive a certain amount of his money to pay our bills everymonth. He went behind my back and stopped it and begin sending money to his sister and her man in Africa because the sister's boyfriend supposedly beat her up and his mother could not send for them. He did not give me money for 3 months. I had to pay all of our household expenses by myself. Because he did not give me money I now owe a payday loan, my car is still in the shop, I owe rent on my office and my car insurance has lapsed because I did not have money to pay the bill. He did not discuss lending money with me and he keeps telling me he is going to take care of the issue. At this point I would like to sue my husband and his mother. Can I do this?

Nope. The law in New York is that if you share in a joint and undivided marital res, you cannot slice away portions out of the air and sue for them. You would need a contract for the court to see the numebrs.

Of course you can. The real question is what would you gain and how much will it cost? Lawsuits against individuals often end up in judgments that are non-collectible. You will likely be unable to find an attorney to take a case like yours on a contingency basis, meaning you will have to pay someone $100-$500 an hour to help you pursue something that ultimately likely does not benefit you. Please do not take the preceding as legal advice. I offer it for informational purposes only. I am not licensed in your state and would encourage you to speak with a lawyer in your state. Good luck!
