De-icing sidewalks and parking lots at apartment complex

4 views 1 answers
With the coming cold weather I have a question about the de-icing of the sidewalks in front of our apartments and the parking lot. Our apartment manager refuses to de-ice or salt either the sidewalks, walkways and the parking lot. Our parking lot is on an incline, when it ices over it becomes very dangerous to walk on. We cannot park on the street because it is marked as no parking. Is there a legal responsibility for the apartment manager to do this? I have offered to buy a 100 gallon drum of environmentally safe deicer and do it myself & have been told if I do this and place it that I will be evicted. As I am disabled and have a hard time walking I am worried about falling again this year and want to be able to deice the parking lot and walkways that I have to use

Generally, property owners have a legal duty to remedy unsafe conditions on their property so long as the condition is known or reasonably can be discovered. The property manager is the landlord's agent, so knowledge of the unsafe condition will be imputed to the owner. Also, it is likely a condition of your lease that the landlord keep common areas at the apartment in good and safe condition. You will need to put your concerns about the conditions in writing to the property manager with a demand that steps be taken to remedy the situation. You may also want to look at your lease to see if there are specific notice provisions applicable to a landlord default. If you take these steps and do not get the response you are looking for, I recommend consult an attorney for assistance.
