Marijuana ACD and Background Check
Anonymous3 views2 answers
I was arrested in January 2010 in NYC and charged with 220.10, possession of marijuana burning or in public view. I was granted an ACD (one year)--and my understanding of this is that as long as I am not arrested again it will be removed from my record. Will this arrest show up on a background check before the one year time is up? What details will appear on the background check? How do I ensure that this is removed from my record after the one year is up?
I really depends on who is requesting the background check, for what purpose, and what kind of check is being conducted. Typically, arrests which have not led to convictions (an ACD is not a conviction) and which are not related to ongoing cases do not show up on background checks. And civilian checks will never show them.
The case will be dismissed and sealed after the one year is us. It should not show up on most background checks but I think it does on checks for jobs with law enforcement and educators. For a definate answer, I suggest you call the Department of Criminal Justice Services in Albany.
