Why do the courts allow extensive visitation to a father indicated in an ACS report, and convicted of domestic violence

I have a stay away order of protection yet my children's father has extensive visitation. He was severaly verbally abusive, in front of my children, he has a conviction of domestic violence and an indicated report from ACS, do all the factors of abuse towards a mother matter at all? Is it only when a case goes to trial that the Judge finally know all the facts and then can modify the visitation schedule or possibly grant the mother sole custody? Domestic violence is a factor in custody, yet during the pendency of an action it does not seem to affect visitation for an abusive man. Please let me know your experience/thoughts on this, it does not make sense for the best interests of the children. thank you.

If the abuse is directed solely towards the mother and does not in any way involve the children, then visitation would ordinarily continue.
