Can a mother fight for child support after 17 years if she told the father after a few months old she wasnt his?

My husbands ex had a child 17 years ago, he signed the birth cert. stating he was the father of this child, only to be told a few months later that the child was not his. Now 17 years later my husband meets the alleged daughter and the mother is wanting to take him to court for child support. Can she legally do this? Does he even have a chance if in deed he does turn out to be the father?

Assuming your husband is the biological father, she can. Whether or how much retroactive child support she can get is up to the discretion of the court. He had reason to believe he had a child yet was also told he wasn't the father. The Texas Family Code establishes the presumption that 4 years of back child support is adequate.

Can probably get one year or so of support. I would not think under these facts that there is going to be any retroactive support.
