Is having a session with a professional dominatrix illegal in Illinois?

I was just wondering if having a session with a professional dominatrix broke any laws regarding prostitution. Assume for the sake of argument that NO oral, vaginal, or anal penetration of any kind occurs, that NO genital stimulation occurs, and that the session consists entirely of spanking and mild flogging ("mild" meaning too gentle to cause any injury). Under these conditions, would paying a dominatrix for her services be illegal in Illinois?

Under the circumstances you describe above, paying a dominatrix for those "services" would be totally legal. As long as there is no exchange of sexual acts for money. The police do occasionally do "reverse stings" in Chicago and the surrounding Suburbs. The stings are conducted on the street primarily, but they have also occasionally used Craigslist. They have not used a dominatrix in my experience. The undercover officer usually specifically mentions a sexual act. (or slang for a sexual act). The street level stings are more aggressive. They are going to assume you know you're picking up a prostitute under those circumstances. So, if you pick up a dominatrix on the street, it could be a problem! As long as the parties consent to the contact (no Battery occurs) and no sex acts at all exist in exchange for money, you are likely okay. But i always hesitate to tell people in advance something is completely legal. The reason for that is two fold - first, you are asking me to make presumptions about what will happen in the future. Second, you need to know that having a lawyer say something is legal is not a defense if you get arrested. Please understand that answering this doesn’t create an attorney/client relationship between us, and as hard as I try to answer your question well, it isn’t legal advice. No matter how much information you put into a question, the answers you are going to get are still going to be vague. John Yetter www.brucarandyetter.com
