Property damages caused by car accident..
Anonymous2 views2 answers
I'm not sure, if this is the right section for my unusual case, but here it is. Few days ago there was a serious accident right next to my house. The dump truck hit an electric pole knocking it down, and causing power outage on the whole block. Falling wires must have shorted, and created an electric surge that fried my TV.
Could someone point me at the right direction on how I should pursue it? Should I get a copy of police report from the accident, and call truck's insurance company directly? Will they even accept my claim, or will I have to go through small claims court? The estimated damages are for about $3000...
Thanks in advanced
Yes, you are on the right track to determine the insurer for the truck and to then submit a claim. The insurer will consider a reasonable claim for replacement value, so do not inflate the claim or you can expect problems.
This answer is offered for informational purposes only. It is not offered as, and does not constitute, legal advice. Laws vary widely from state to state. You should rely only on the advice given to you during a personal consultation by a local attorney who is thoroughly familiar with state laws and the area of practice in which your concern lies.
I agree from that the way you described the accident that the trucking company should be liable for your damages. You can contact them directly after gettting the police report. If they do not respond or give you a satisfactory offer, you can then file a complaint in the Special Civil Part in New Jersey. You can file the claim yourself and the forms to do so are online on the NJ Judiciary website.
