How long can an employer take to fix an incorrect paycheck

4 views 1 answers
I work for a large company and am supposed to recieve commission and hourly pay. I have been paid the hourly pay but the the commission. I have been with the company 8 weeks now and was told I would be receving commission from day one. I have notified the store manager and the human resouce department. They have yet to fix the problem, and no one can give me an answer when I will be paid. It has now been at least 2 week since I notified them of the issue.

Failure to pay accrued wages can subject an employer to waiting penalties if the employer acts in "bad faith" in failing to pay. Yours does not seem to be a situation where there is some explanation as to why you have not been paid (a clerical error). I suggest you refer to the link I have attached below which set forth not only the time periods for when pay is due but also links to remedies for you. This is the official site for the labor commissioner (the Department of Industrial Relations) and you may pursue help through the agency or seek relief yourself in Court if you cannot resolve the issue. Good luck and hope this helps you.
