I was assaulted by myneighbor. The police didn't beieve me and did nothing. I had been charged with criminal mischief of this neighbors property. However, the judge found me not guilty and said that the neighbors were not credible. He said that my testimony was straight forward, consistent and that I was credible. SO, in effect, he called the neighbors liars. Can I ask that shenow be charged with the assault, based on the outcme of thecourt case?

The police and DA have discretion to decide which cases to pursue. Accordingly, you cannot force them to criminally charge your neighbor. That said, assault is a tort and you could consider filing a lawsuit in civil court for any damage you suffered. There are costs involved in pursuing a lawsuit, even if you do not hire an attorney to help you. You should evaluate whether your damages are sufficient to cover these costs. You should also consider whether filing a lawsuit is in your best interests because it may exacerbate your conflict with your neighbor and make things more difficult. Good luck.
