Unemployment appeal

My former employer is appealing my claim, I already have been collecting. We have had 2 tribunal telephone hearings already (the first post-poned b/c employer dis-connected) and now this one is post-poned in my favor so I can access my hr files from employer. I contacted employer and they are refusing(telling me they are not required by law, which I found out in nj) to give them to me. I called right back and asked if they could send a letter or anything in writing telling me they could not send me my files and/or that I requested them. They did not do that either, refusing. The examiner said I do not need a supeona, b/c it's just a hearing. Obviously the company does not want me to have these or cooperate. Does this benefit me with the appeal? Is there any way to obtain my records?

Every determination that affects your eligibility for unemployment insurance benefits will be given to you in writing. If you disagree, you have the right to file an appeal. Your appeal rights are printed on each determination you receive. Any party to a proceeding before the Board of Review may secure judicial review of the final decision of the Board of Review by filing a written appeal within 45 days of the mailing date of the decision.
