How to file for custody if there is already a child support case

Business Questions 2 views 1 answers
My child's father and I have already had a child support case. Now I would like to get sole legal and physical custody of our child. The father has agreed to give me legal and physical custody. We even have a parenting plan that we both worked on. I need to know how I go about getting this done.

Some counties in Nebraska prefer that you file a complaint to modify to ask the court to address custody/parenting time issues in the same case as the child support case. Other counties require you to file a separate custody action. As far as I know there are no forms to do this. If both parents are in agreement, it may be easy to find an attorney that charges a flat fee to draft the paperwork and go through the proper procedures in the county where you are residing.
