t it? I have been a toll road customer for over 5 years and had just bought a new car 3 days prior. When I was pulled over because the transponder didn't work the CHP officer said the Velcro was not fastened properly and that is a toll evasion. This seems like complete bs!! On top of that they are considering it a moving violation and the ticket is 240.00 with the option of traffic school. I really would appreciate a legal argument to this so I don't lose my temper in court. Any suggestions?

For this type offense I would suggest you hire a traffic ticket attorney. They will know how to deal with this situation, the court and the officer. You must fight every ticket that is considered a moving violation.

Yes you can fight it. You should gather your previous bills from the toll roads to show you have regularly been paying the toll for a number of years, also get a copy of your purchase contract for the new car. Then you can either bring these to court for a hearing or do a trial by decleration and submit your argument and the documents thru the mail. You can do this by yourself or hire an attorney to help you. If you have more questions feel free to contact me.
