What can I do to recover title to my car that was fraudulently transferred to someone else? Is it a crime or a civil matter?

I have the pink slip in my possession. I was conned into allowing someone to take my new, VERY expensive automobile, and pay for it later when he got a lawsuit settlement. He failed to pay, and refused to give me back my car upon request. When he had an accident a few weeks ago, I learned that he now is, according to DMV, the legal owner of the car. I have NO WAY of knowing how he did that. DMV thinks he might have first claimed a lost pink slip and then forged my signature on the pink slip. But DMV will not put the car back into my name, because it is now a civil matter. They gave me instructions as to how to get Superior Court to issue an injunction, ordering the car back into my name, but Superior Court says they cannot help, because it is a criminal matter. The police say it is a civil matter, so they cannot help. Which is it, and what can I do?

I hope you had the good sense to prepare a written contract for the sale of the vehicle. You need to file suit against the individual for fraud and conversion. You can file a police report, but the police are unlikely to do anything. Suggest you contact a lawyer in your area that handles fraud cases.

Well, I hope it's not too late, because I have a suggestion that might help. Order from DMV a copy of the application for replacement pink slip, of the new pink slip and any other papers by which he got title in his name. One of them will have your forged signature on it. Take that to the police and tell them you are the victim of a forgery and fraud. Take copies to the D.A. too. THEN they will have a criminal case. The way you presented it the first time, they did not have that evidence. So do some foot work and lay it out to them. Then you can also get a lawyer to sue civilly to get a judge to order the DMV to put title back into your name, AND to order the police to issue a stolen vehicle bulletin on the car so it can be seized. That should get things started. For further information you can review the articles on http://Dinday.com. Good luck.
