If they can, you need to make a written discovery request asking for it. But you really shouldn't be defending a DUI case on your own. Hiring an experienced DUI attorney can save you jail time, and considerable amounts of money.

You have a right to represent yourself but remember that the court will not change the rules for you. I would suggest that you start by looking at MS’s Rule of Criminal Procedure, Rules of the Court, and all applicable statutes. You do have a right to request Discovery but the prosecuting attorney and the court will expect you to work within the established legal parameters. If you get stuck, then consult with a local experienced DWI lawyer. Disclaimer: This communication is not intended as legal advice, and no attorney client relationship results. Mississippi Code Annotated Section 63-11-15 directly address your situation. It reads as follows: "Upon the written request of the person tested, or his attorney, full information concerning the test taken at the direction of the law enforcement officer shall be made available to him or to his attorney" As in any DUI matter, I would advise you to contact an attorney and discuss your options.
