Contesting a Cell Phone Ticket (14-296aa) in Connecticut
Anonymous2 views2 answers
This morning I was pulled over on I-91 when I looked down into my hand at hand-written directions. He said very quickly I had been pulled over for use of an electronic device and went back to his squad car. It took me a minute to realize that he was pulling me over for using a cell phone (wasn't even in my car).
He came back with the ticket and I asked politely, "what did I get pulled over for again, officer?" He said he saw me look down at an electronic device. I told him I was was looking at directions to the bank which I flashed to him. He said, "it doesn't matter, this is the same offense as distracted driving."
1) He got my DOB wrong; 2) he cited me for driving a bus (c) not a vehicle (b); 3) I could only get cited for distracted driving (j) if I committed a moving violation
I am not an attorney in Connecticut, but you ought to consult with a Connecticut traffic attorney on this infraction to see what kind of points you might get and how this infraction might affect your insurance premiums.
While you may be correct, how you present your defenses is critical, and an attorney can often be very helpful. As I lived in CT for many years and still go there with some frequency, I have seen police officers there become more aggressive with traffic enforcement over the years. Because electronic device and cell phone infractions are fairly new offenses, the officer could have easily made a mistake. This is another reason why it makes sense to contact an attorney who practices with some regularity traffic ticket defense.

I am a Connecticut Attorney and it is my opinion that you should contest this ticket and fight it. Based on the facts you have stated, you have not done anything wrong here. You may be able to handle this without an attorney, but an attorney can very likely get this matter dismissed for you with greater ease.
